TSCC 1431 Declaration - Schedule “C”
Boundaries Of Units
Each Residential Unit, Guest Suite Unit, Parking Unit, Locker Unit, Recreational Unit, Washroom Unit and Service Unit shall comprise the area within the heavy lines shown on Part 1, Sheets 1 to 6 inclusive of the Description with respect to the unit numbers indicated thereon. The monuments controlling the extent of the units are the physical surfaces and planes referred to below and are illustrated on Part 1, Sheets 1 to 6 inclusive of the description and all dimensions shall have reference to them.
Without limiting the generality of the foregoing, the boundaries of each unit are as follows:
- Boundaries Of The Residential Units
(being Units 1 to 13 inclusive on Levels 3 to 21 inclusive and Units 1 to 8 inclusive on Levels 22, 23 and 24). - Boundaries Of The Guest Suite Units
(being Units 1 and 2 on Level 2).- Each Residential Unit and Guest Suite Unit is bounded vertically as follows:
- the upper surface and plane of the concrete floor slab and production.
- the lower surface and plane of the concrete ceiling slab and production.
- Each Residential Unit and Guest Suite Unit is bounded horizontally by:
- the upper surface and plane of the drywall sheathing separating one unit from another such unit or from the common elements.
- the unit side surface of exterior doors, door frames, window and window frames, said doors and windows being in a closed position and the unit side surfaces of the glass panels contained therein.
- in the vicinity of ducts, pipe spaces and concrete columns, the unit boundaries are the backside surfaces of the drywall sheathing enclosing said ducts, pipe spaces and concrete columns.
- Each Residential Unit and Guest Suite Unit is bounded vertically as follows:
- Boundaries Of The Parking Units
(being Units 1 to 82 inclusive on Level A and Units 1 to 102 inclusive on each of Levels B and C).- Each Parking Unit is bounded vertically by:
- the plane measured 2.10 metres perpendicularly above and parallel to the concrete floor slab.
- the upper surface and plane of the concrete floor slab and production.
- Each Parking Unit is bounded horizontally by one or a combination of the following:
- the vertical plane established by measurement.
- the vertical plane established by the centerline of columns and production.
- the unit side surface and plane of concrete or concrete block walls and production.
- the vertical plane established by the line and face of concrete columns and production.
- the vertical plane established perpendicular to the concrete wall and passing through the centerline of the concrete columns and production.
- the vertical plane established by measurement and perpendicular to the concrete wall.
- the unit side surface and plane of the steel wire mesh and frame for Units 8, 9, 41 and 42 on Level A.
- Each Parking Unit is bounded vertically by:
- Boundaries Of The Locker Units
(being Units 2 to 158 inclusive on Level 1 and Units 6 to 119 inclusive on Level 2).- Each Locker Unit is bounded vertically by:
- the upper surface and plane of the concrete floor slab and production. ii) the lower surface and plane of the steel wire mesh and frame.
- Each Locker Unit is bounded horizontally by one or a combination of the following:
- the backside surface and plane of the drywall sheathing and production on walls separating the Unit from the common elements.
- the unit side surface of the concrete or concrete block walls and production on walls or columns separating the unit from the common elements.
- the unit side surface and plane of the steel wire mesh and frame separating one Unit from another Unit or the common elements.
- the unit side surface and plane of the steel wire mesh door and frame, said door being in a closed position.
- Each Locker Unit is bounded vertically by:
- Boundaries Of The Recreational Units
(being Unit 159 on Level 1 and Unit 3 to 5 inclusive on Level 2). - Boundaries Of The Washroom Units
(being Unit 120 on Level 2).- Each Recreational Unit and Washroom Unit is bounded vertically by:
- the upper surface and plane of the concrete floor slab and production.
- the lower surface and plane of the concrete floor slab and production in the uppermost portions of the Unit.
- Each Recreational Unit and Washroom is bounded horizontally by:
- the backside surface of the drywall sheathing and production on walls separating the Unit from the common element or another unit.
- the exterior surfaces and planes of the exterior doors and door frames, windows and window frames, said doors and windows being in a closed position and the exterior surfaces of all glass panels contained therein.
- Each Recreational Unit and Washroom Unit is bounded vertically by:
- Boundaries Of The Service Unit
(being Unit 1 on Level 1).- The Service Unit is bounded vertically by:
- the upper surface and plane of the concrete garage roof slab.
- the plane measured 8.0 metres perpendicularly above and parallel to the concrete garage roof slab.
- The Service Unit is bounded horizontally by:
- the unit side surface and plane of the concrete curb and production.
- the unit face and plane of the building wall and production across opening.
- the vertical plane established by the property limit of this condominium.
- The Service Unit is bounded vertically by:

Reference should be made to the provisions of the Declaration itself, in order to determine the maintenance and repair responsibilities for any Unit and whether specific physical components (such as any wires, pipes, cables, conduits, equipment, fixtures, structural components and/or any other appurtenances) are included or excluded from the Unit, regardless of whether same are located within or beyond the boundaries established for such Unit.
